These Terms & Conditions govern your use of this website and any purchase you make from Nicola Captures ("we", "us", "our"). Please read them carefully. By placing an order you agree to these terms.
1. Who we are
Nicola Captures, trading as Nicola Captures. You can contact us at shop@nicolacaptures.co.uk.
2. Our products
We sell photographs as high-resolution digital downloads and as physical prints made to order. Images shown on the site are watermarked, lower-resolution previews; the file or print you receive is supplied without a watermark and at full quality.
3. Prices and payment
- All prices are in pounds sterling (GBP). Postage, where it applies, is shown at checkout before you pay.
- We accept payment by debit/credit card (processed securely by Square) and by bank transfer (BACS).
- For bank transfer orders, your order is reserved and only fulfilled once we have received cleared funds, quoted against the unique reference shown at checkout.
- We do not see or store your full card details; card payments are handled by Square.
4. Orders and acceptance
Your order is an offer to buy. A contract is formed when we confirm your order and (for card payments) your payment is authorised, or (for bank transfer) when we receive your payment. If we cannot fulfil an order we will contact you and arrange a full refund.
5. Delivery
- Digital downloads: supplied as secure, time-limited download links sent by email once payment is confirmed. Links typically remain valid for 30 days. Please download and back up your files promptly.
- Prints: produced to order and sent to the delivery address you provide. We will give an estimated timescale; delays by postal/courier services are outside our control.
6. Cancellations, refunds and your rights
Your statutory rights under the Consumer Contracts Regulations 2013 and the Consumer Rights Act 2015 are not affected. In particular:
- Digital downloads: by purchasing and choosing to download immediately, you consent to the supply of digital content beginning at once and acknowledge that you lose the 14-day right to cancel once the download has started.
- Prints: prints are made to your order and are therefore exempt from the standard 14-day "change of mind" cancellation right.
- Faulty, damaged or incorrect items: if a print arrives damaged or faulty, or a digital file is corrupt or not as described, contact us within a reasonable time and we will repair, replace or refund as appropriate.

7. Copyright and licence
All photographs remain the copyright of Nicola Captures at all times. When you buy a digital download or a print you receive a personal, non-commercial licence to use the image for your own private enjoyment. You must not copy, resell, redistribute, sub-licence, or use any image for commercial purposes, and you must not remove or alter any copyright notice, without our prior written permission.
8. Acceptable use
You agree not to misuse the website, attempt to gain unauthorised access, or interfere with its operation. Watermarked previews are provided for selection only and must not be saved, copied or used.
9. Our liability
We do not exclude or limit liability where it would be unlawful to do so (including for death or personal injury caused by our negligence, or for fraud). Otherwise, our total liability arising from any order is limited to the amount you paid for that order. We are not liable for losses that were not foreseeable.
10. Changes
We may update these terms from time to time. The version in force is the one published on this page at the time you place your order.
11. Governing law
These terms are governed by the laws of England & Wales, and disputes are subject to the courts of England & Wales. [If the business is based in Scotland or Northern Ireland, update this section accordingly.]
